https://herbaskida.com ("Site") is operated by Milenyums Dijital Fotoğrafçılık Reklam Ajansı Sanayi ve Dış Ticaret Limited Şirketi. By using the Site, you are deemed to have accepted these terms. The scope of the terms is determined based on the modules, widgets, and integrations that are active on the site.

1. Definitions

• Operator: Milenyums Dijital Fotoğrafçılık Reklam Ajansı Sanayi ve Dış Ticaret Limited Şirketi
• User: Natural/legal persons who visit the site or benefit from its services

2. Scope of Services

The services offered through the website are limited to the features enabled by the Operator. The Operator may change the scope, content, and presentation format of the services upon providing prior notice; and may temporarily suspend access due to technical maintenance and updates.

3. Prohibited Behaviors

• Using another person's identity or payment information
• Copying, reproducing, or using the site's content without permission for commercial purposes
• Transmitting content that violates laws, ethical standards, or the rights of third parties

6. Price, Stock and Orders

Prices are shown inclusive of VAT and are subject to change without prior notice; the price at the time of order applies to the placed order. Stock information is updated in real time; in the rare event of a stock discrepancy, the order will be canceled and the payment refunded. In the case of an obvious typographical or pricing error, the Operator may cancel the order. Detailed sales terms are set out in the Distance Sales Agreement and the Preliminary Information Form.

7. Paid Membership Terms

Paid membership is valid for the period it is purchased and its scope is announced on the membership page. You can cancel your membership at any time; cancellation is effective at the end of the current period and no refund is made for the used period. If the operator changes the scope of membership, the change is applied from the new period.

8. Personalization Contents

You are responsible for ensuring that the content you upload for personalization is legally compliant in terms of copyright, trademark rights, and personal rights. Orders containing illegal, infringing, or disturbing content are canceled before production and the payment is refunded. Cases where the right of withdrawal cannot be exercised for products produced specifically for individuals are explained in the Cancellation, Refund and Exchange Conditions.

9. Delivery

Delivery time, shipping fees, and delivery terms are explained on the Delivery and Shipping Information page. The Operator is not responsible for delays resulting from incomplete or incorrect address information.

10. Booking Conditions

A reservation is established when payment or confirmation is completed. Cancellation and change conditions are subject to the rules shown during booking and the Cancellation, Refund and Exchange Conditions page. Relevant rules apply to reservations that are not used at the specified time.

11. Messaging Rules

Messaging channels cannot be used for harassment, threats, spam, or sharing content that is against the law. Messages that violate these rules will not be responded to and may be reported to the relevant authorities in necessary cases.

12. Digital Products

When a digital product, license key, or downloadable content is purchased, delivery is made via your account or email after the purchase. According to the Distance Contracts Regulation, Article 15/1-ğ, there is no right of withdrawal for intangible goods that are instantly performed and delivered to the consumer in electronic form; this matter is additionally approved before the purchase.

13. Print Orders

By uploading your files, you declare that you own the copyright and usage rights. For personalized printed products, the right of withdrawal cannot be exercised according to the Distance Contracts Regulation, Article 15/1-b. The printed result may vary to a limited extent due to the difference in color space between screen and print.

14. Disclaimer

The site is provided "as is". The operator does not guarantee uninterrupted or error-free service; it is not responsible for the content of third-party links. To the extent permitted by law, no liability is accepted for indirect damages. Your rights under consumer legislation are reserved.

15. Force Majeure

In unforeseen circumstances such as natural disasters, war, cyberattacks, infrastructure and communication outages, or regulatory changes, the Operator's obligations are suspended.

16. Personal Data

Your personal data is processed in accordance with the Privacy Policy and the KVKK Information Notice; cookie usage is explained in the Cookie Policy.

17. Changes

These terms may be updated; when a new module, widget, or integration is activated on the site, the relevant clause is automatically added to the text. The current version is published on this page and takes effect immediately upon publication.

18. Governing Law and Jurisdiction

These terms shall be governed by Turkish law. In disputes, the courts and execution offices of İstanbul shall have jurisdiction; for consumer transactions, Consumer Arbitration Committees and Consumer Courts shall have jurisdiction according to monetary limits.
